43RZ17 - The Registration Fee Discretion Act

WHEREAS, Current law directs the Secretary of State to charge a fee of 13¤20, or $20 USD, for new political parties, and

WHEREAS, Problems have arisen from making payment, as well as controversy about the legal status of some political parties, and

WHEREAS, A previous draft of this bill failed in a previous Cosa on concerns of a loophole in the bill, and

WHEREAS, Such loophole has been fixed and the bill is now Organic, and

WHEREAS, It is still high time to fix the problem, now

THEREFORE, we, the Ziu, hereby enact the following:

Section 1: The Secretary of State shall have full discretion on whether a party can proceed with registration should a problem arise with receipt of the filing fee for that party.

Section 2: Any disputant, showing good cause, may appeal the Section 1 decision made by the Secretary of State, and during such time as it is going through the process of appeal, the party shall be registered until a decision has been made by the Cort on such appeal.

Section 3: If a disputant has made a Section 2 appeal, and the decision of the Cort calls for the party to be stricken from registered status, the party shall be made to vacate their seats immediately, and the Secretary of State shall be made to expunge any and all votes cast in the Clark taking place at such time.

Section 4: Any party that has been deemed not to be registered may not reclaim their vacated seats due to their non-registered status.

Section 5: The vacated seats shall be allocated proportionally to each registered party according to the current composition of the Cosa, subject to the approval by the King.

Section 6: By no means can Section 1 or 2 of this act can be construed to deny a party registration if such party has paid its filing fee in full and the fee has been received by the Burgermeister of Inland Revenue and/or the Ministry of Finance.
