21RC34 - Second Multiple Office Prohibition Act

WHEREAS, early Talossan history necessitated that one person held several offices in a government; and,

WHEREAS, there are more than enough people in Talossa today to provide positions for everyone in the government, Not just a selected few; and,

WHEREAS, having someone serve in more than one key governmental position can create potential conflicts of interest, especially someone who might be both the Prime Minister and a member of the Cort at the same time, and,

WHEREAS, there is currently no means of prohibiting individuals from holding more than one key post in Talossa, and,

WHEREAS, Article 60 of the Constituziun allows for the SoS to appoint a deputy SoS who would execute all of the powers and duties of that office when the SoS cannot, effectively allowing for any key office holder to serve as the deputy SoS if and when necessary,

NOW, THEREFORE BE IT RESOLVED by the 21st Cosd of the RT that Article 55c and Article 78a shall be added to the Talossan Constituziun, to read as follows:

Article $5c, No one may hold more than one of the following key offices or positions at the same time unless the total population of Talossa drops below 6 (six). The key offices or positions are King, Prime Minister, Uppermost Cort Justice and Secretary of State. Any individual holding one of these offices must resign their current position before accepting another of the key offices listed above.

Article 78a. In the event that an Uppermost Cort Justice wishes to serve as Prime Minister or Secretary of State, that Uppermost Cort Justice must step down temporarily. The Uppermost Cort Justice may appoint another Talossan citizen who qualifies to serve in their place until such time as the Uppermost Cort Justice wishes to return to the Uppermost Cort, having completed their tenure as Prime Minister or Secretary of State. During the tenure of the interim Uppermost Cort Justice, the individual must accept all rights, duties and responsibilities pertaining to the position, refraining from simply serving as a proxy vote for the Justice who they are temporarily replacing. An Uppermost Cort Justice must resign their position unequivocally in order to ascend the throne.
