18RC17 - The Judicial Responsibility (Amendment) Act

Clarked in the Third Clark (September 1994) of the 18th Ziu

Whereas, the Uppermost Cort as it is currently constituted has virtually no responsibility to abide by the Constitution, law or precedent; and whereas, such lack of accountability can--and has--led to well-founded accusations of arbitrariness and unfairness, the Cosa hereby resolves to add to the Constitution the following requirements for the Uppermost Cort:

When rendering its verdict on a case, the Uppermost Cort must in part account for its decision by answering in writing these three questions:

  1. How, specifically, does the text of Constitution justify this decision?

  2. How, specifically, do current laws justify this decision?

  3. How, specifically, does Talossan legal precedent or custom justify this decision?

Additionally, the Cort must identify in writing the central argument or arguments which it rejected in its decision and explain why such argument/s were rejected.
